As we embark on our holiday or business trip, it's good to know that EU passenger rights protect us in case something goes wrong while travelling. EU rules ensure a minimum level of protection for passengers, regardless of the mode of transport: flight, train, coach or ship. Travel can be difficult, with unexpected delays, cancellations and lost luggage. That's why MEPs helped introduce EU rules that oblige transport companies to provide travelers with meals, accommodation and compensation if something happens. Transport companies in the EU can no longer charge more for tickets based on nationality and location of purchase. EU legislation also guarantees special attention to passengers with reduced mobility who are entitled to free help services.
Air passenger rights
Air passenger rights apply under certain circumstances, for example if the flight is operating within the EU or if the flight is departing from an EU country to a non-EU country. In the event of denied boarding, the passenger is entitled to assistance which may include refreshments, meals and accommodation. The airline is required to give a choice between refund and rerouting. The passenger is also entitled to compensation of up to 600 euros. The amount of compensation depends on the distance of the flight.
In the event of a flight cancellation, the passenger is entitled to free assistance as well as a refund, rerouting or a return flight. In the event of a flight delay, this depends on the length of the delay and the distance of the flight.
Passengers whose flights were canceled at the last minute or arrived at their final destination with a delay of more than 3 hours are also entitled to the above compensation, but with certain limitations. It does not apply to companies offering an alternative or in extraordinary circumstances such as air traffic management decisions, political instability, adverse weather conditions or if there is a risk to the safety of passengers.
Rights of ship passengers
EU rules on ship passengers' rights apply when you travel on cruise ships or on inland waterways (rivers, lakes or canals) and if you travel to or from an EU port. If your ship is delayed or cancelled, you may be entitled to assistance in the form of meals and accommodation. You are entitled to compensation if the route is delayed for more than 90 minutes.
